Terms of Service

Saved By The Plan is a product and service of OLYV LLC (“OLYV,” “we,” “us,” or “our”). OLYV LLC is the legal seller; Saved By The Plan is not a separate legal entity.

Please read these Terms: we turn the curriculum you are authorized to submit into a lesson-plan PDF and email it to your verified account address. We do not keep a customer plan library or curriculum repository. You must never submit student personal information.

1. Acceptance, eligibility, and account

These Terms govern your use of Saved By The Plan. Before you first submit curriculum or open paid checkout, the service presents the current Terms and Privacy Notice for affirmative acceptance. By checking the agreement box and then submitting curriculum, subscribing, or otherwise using the service, you agree to them. You must be at least the age of majority where you live and have authority to enter this agreement and, if you use the service for an organization, to bind that organization. The service is for adult teachers and other authorized education professionals; it is not for students. At this launch, the paid subscription offer is available only to an account with a U.S. billing address. Do not begin paid checkout if your billing address is outside the United States.

You must provide and keep access to a valid email address. Passwordless sign-in links and final plan PDFs are sent to that address. You are responsible for safeguarding access to your email account and for activity using your account.

2. The service and educational responsibility

Saved By The Plan is a planning aid that creates a curriculum-grounded lesson plan from material you choose to submit. It is not legal, copyright, curriculum-publisher, special-education, medical, or professional educational advice. AI-generated or AI-assisted output can be incomplete, inaccurate, unsuitable, or unavailable. You must review every plan and use your own professional judgment before using it with students.

We may use automated systems and service providers to process a request. We do not guarantee a particular educational result, curriculum alignment, classroom outcome, availability, delivery time, or that a plan will satisfy a school, district, publisher, accreditor, or legal requirement.

3. Your curriculum, permissions, and strict student-data prohibition

You are responsible for every page, image, document, text, and other material you submit. You represent that you have the rights, permissions, licenses, authority, or other legal basis needed to submit and use it with the service.

Do not submit student personal information. This includes, for example, student names, email addresses, IDs, grades, attendance, IEP/504 information, health information, disciplinary information, or identifiable student work. District or school approval does not override this prohibition in this service. Do not submit unlawful, harmful, abusive, infringing, confidential, or otherwise unauthorized material.

We do not grant you a license to copy, distribute, adapt, or otherwise use publisher, school, district, or third-party material. You remain responsible for copyright, license terms, fair use, privacy laws, school/district policy, and every other requirement applicable to your material and your use of the final plan.

4. Content and output rights

As between you and OLYV, you retain any rights you have in your submitted material. You give OLYV a limited, non-exclusive permission to process that material only as needed to operate, secure, troubleshoot, and provide the requested lesson-plan service. Subject to these Terms and applicable law, you may use the final plan we send you. That permission does not override rights, restrictions, or licenses in your submitted material or any quoted or source-derived content in the plan.

We do not claim ownership of your curriculum solely because you submit it. We may use de-identified, content-free operational information to run and improve reliability; we do not use your curriculum or final plan as a customer-content library or owner/admin viewer.

5. Uploads, email delivery, and saved content

You may stage up to nine curriculum files or camera photos for one lesson request. You can take one camera photo at a time, up to that total, before selecting the lesson-creation button. The service evaluates no more than nine processed source units: a photo, image file, PDF page, or PowerPoint slide is ordinarily one unit; a DOCX or plain-text file may be treated as one technically limited text source rather than counted by its physical page count. We may reject unsupported, unreadable, oversized, unsafe, unauthorized, or technically over-limit uploads.

After the service durably accepts your upload, you may leave the page while the request continues. When successful, we render the final plan as a PDF attachment and send it to the verified account email. The request is considered delivered for service and credit purposes when our transactional email provider accepts the message for delivery. Delivery to your inbox can still be delayed, filtered to spam, rejected, or bounced by recipient or mailbox providers. If we cannot confirm whether the provider accepted an email request, we remove the working plan payload after our safe retry window and show a support-required status instead of claiming that the email failed or that the credit was unused.

We do not provide a customer plan library, saved curriculum repository, or finished-plan history. The final PDF is rendered in memory for email delivery; our working plan data is designed to be cleared when delivery succeeds or reaches a terminal failure. Keep the email attachment and your own lawful copies if you need the plan later.

6. Pricing, credits, billing, cancellation, and refunds

Subject to U.S. billing eligibility, the public subscription is $9.99 USD per month, charged in advance through Stripe, and includes up to 20 completed lesson plans per billing month. It automatically renews monthly unless you cancel. Unused credits do not roll over. An eligible verified teacher receives one no-charge introductory lesson credit. It is not a recurring subscription benefit, has no cash value, and may not be transferred or combined with another account. Before enrollment, checkout will identify the current price, billing frequency, renewal terms, and taxes if applicable. To cancel online, sign in and select Manage subscription in the Account menu to open the Stripe Billing Portal. If that portal is temporarily unavailable, email support@savedbytheplan.com.

A credit is reserved when an eligible request begins and is committed only when the email provider accepts the final PDF for delivery. If the request reaches terminal failure before that point, we normally release the reservation. If an infrastructure outage prevents us from immediately confirming that bookkeeping, we keep the request in a pending recovery or support state and do not tell you that the credit was unused until it is resolved. An email outcome we cannot confirm is not treated as a terminal failure: the credit remains held while support reviews it. Re-submitting a completed lesson uses another available credit. We may prevent duplicate processing and may require you to submit again if the curriculum is incomplete, unreadable, unsupported, or fails the source-validation process.

Stripe processes payment details under its own terms. A U.S. billing address is required for paid access; if Stripe reports a different billing country, paid lesson access will not activate and you should contact support before attempting another checkout. Applicable taxes may be calculated and collected at checkout. You may cancel through the Stripe Billing Portal; cancellation takes effect at the end of the already-paid billing period. If a renewal payment fails, new lesson creation stops until payment is restored. We do not promise automatic refunds. Refund requests are reviewed where required by law or where we determine one is appropriate.

7. Acceptable use and suspension

You must not attempt to bypass authentication, payment, credit, page, rate, security, or access controls; probe or interfere with the service; use it unlawfully; submit prohibited content; impersonate another person; resell access without our written permission; or use the service to create a competing content repository. We may suspend or terminate access, cancel queued work, or take other reasonable action to protect users, OLYV, providers, or others. We will not intentionally use a suspension to withhold a paid service where law requires otherwise.

8. Changes, availability, and termination

We may change, suspend, or discontinue all or part of the service for security, legal, operational, provider, or business reasons. We may update these Terms prospectively by posting a new effective date and revision identifier and, where appropriate, asking you to accept the new version before a future curriculum request. You may stop using the service at any time. Sections that should reasonably survive termination, including payment obligations, content responsibility, disclaimers, and limits of liability, survive.

9. Disclaimers and limit of liability

To the fullest extent permitted by law, the service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted availability, or error-free operation. Some jurisdictions do not allow every disclaimer, so some of these limits may not apply to you.

To the fullest extent permitted by law, OLYV LLC and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, classroom time, or business opportunity arising from or related to the service. OLYV LLC’s total liability for a claim related to the service will not exceed the amount you paid to OLYV LLC for the affected billing period. Nothing in these Terms limits liability that cannot lawfully be limited.

10. Electronic communications and contact

You agree that we may provide notices, policy updates, receipts, and service communications electronically, including by email and through the service. Questions or support requests may be sent to support@savedbytheplan.com.

These Terms do not replace legal advice about your school, district, employer, publisher licenses, privacy obligations, or classroom use. Consumer-protection laws may give you rights that these Terms cannot waive.
